1. Acceptance of Terms
By creating a Nomox account and/or using the platform, you accept these Terms and Conditions in full. If you disagree with any of them, do not use the service.
2. Description of service
Nomox is a software platform that allows users to configure and run algorithmic trading bots connected to third-party broker accounts via their APIs. Nomox provides technology tools; it is not a broker, financial advisor, investment manager, or regulated financial entity.
3. Not financial advice
Nothing offered by Nomox — including bot configuration, algorithmic strategies, dashboard metrics, or any other content — constitutes financial, investment, tax, or legal advice. Investment and trading decisions are the sole responsibility of the user.
4. Trading risks
RISK WARNING
Trading financial instruments (stocks, cryptocurrencies, derivatives, etc.) carries a high risk of capital loss. It is possible to lose all invested capital. Past results do not guarantee future results. Algorithmic trading adds additional risks, including technical failures, execution latency, software errors, and extreme market conditions.
You should only trade with money you can afford to lose. If you do not fully understand the risks, do not use live mode.
5. Disclaimer of liability
IMPORTANT
- Nomox, its creators, developers, administrators, and collaborators shall not be held liable for any financial loss, lost profits, direct, indirect, incidental, special, or consequential damages arising from the use of the platform or trades executed by the bot.
- The user understands and accepts that the bot operates automatically and that results depend on unpredictable market conditions. Nomox does not guarantee profitability or the absence of losses.
- Nomox is not responsible for service interruptions, broker connection failures, order execution errors, or any event beyond our reasonable control (force majeure, third-party server outages, changes in broker APIs, etc.).
- The user is solely responsible for account configuration, risk level selection, operating mode (paper/live), and supervision of bot activity.
- In no event shall Nomox's total liability exceed the amount paid by the user for the service during the 12 months prior to the event giving rise to the claim.
6. User account
- You must be at least 18 years old (or the legal age in your jurisdiction) to use the platform.
- You are responsible for maintaining the confidentiality of your login credentials and API keys.
- Accounts require administrator approval before trading is enabled.
- We reserve the right to suspend or cancel accounts that violate these terms or use the platform abusively.
7. API Keys and custody
Nomox does not hold funds. API keys provided are used exclusively to send orders to your broker account. We recommend configuring keys with minimum necessary permissions (no withdrawal permissions).
8. Intellectual property
All code, design, branding, algorithms, and content of Nomox are owned by its creators. Reproduction, distribution, or reverse engineering is not permitted without written authorization.
9. Service "as is"
The platform is provided "as is" and "as available", without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
10. Paper mode
Nomox offers a "paper trading" (simulation) mode so users can try the platform without financial risk. Paper mode results are not indicative of future results in live mode.
11. Modifications
We reserve the right to modify these Terms at any time. We will notify you of material changes. Continued use of the platform after notification constitutes acceptance of the new terms.
12. Applicable law
These Terms are governed by Spanish law. For any dispute arising from the use of the platform, the parties submit to the jurisdiction of the competent courts.
13. Regulatory status and SaaS nature
Nomox is a Software as a Service (SaaS) automation platform. It is not registered, licensed, or regulated as a broker, investment advisor, portfolio manager, or financial institution by any regulatory authority — including, but not limited to, the CNMV (Spain), SEC, FCA, or ESMA. Nomox does not: provide personalized investment advice; manage, pool, or custody client assets; execute trades on its own account; or guarantee any return. Your funds are held exclusively in your own broker account. Nomox connects to that account via API keys you provide and executes orders solely under your direction. The regulated broker is Alpaca Markets, Inc. (SEC-registered broker-dealer, FINRA/SIPC member) — not Nomox. By registering and using the platform you explicitly acknowledge Nomox's nature as an automation software tool and not a regulated financial service.
